Conditions of Use

DKAT Internet Services ("DKAT") provides Timesheet System services ("Service") to those persons ("Users") who utilize its Service.

By using the Service, each User agrees to be bound by all of the Conditions of Use set forth in the following paragraphs.

DKAT undertakes no responsibility to review or monitor the contents of any information provided by Users, and by using the Service each User agrees that DKAT shall have no liability for such contents.

Each User hereby indemnifies DKAT against any liability relating to the Users use of the Service.

This Service may not be utilized for unwanted E-mail, spamming, offensive or illegal communications, communications which infringe intellectual property rights, or communications which harrass, intimidate or otherwise violate the rights of others. DKAT reserves the right to block any User from using this Service.

DKAT may configure the Service with maximum use limits based on the monthly payment of User. Such limits include a maximum amount of timesheet records, and a maximum amount of characters that can be typed into each field. Currently, the default maximum character limits for each timesheet are: Comments - 2000 and 10 digits per timesheet cell. Requests for changes to these default settings may be sent to Sales@dkat.com. Additional charges may apply and would be explained.

Under no circumstances, including, but not limited to negligence, shall DKAT be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if DKAT or a DKAT authorized representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall DKAT's total liability to you for all damages, losses, and causes of action (whether in contract, tort including, but not limited to, negligence), or otherwise exceed the amount paid by you to DKAT Internet Services, if any, that is related to the cause of action.

DKAT is not responsible for damage or loss caused by errors in the system or the Internet. The system may be unavailable unexpectedly as a result of errors or circumstances beyond our control.

The Conditions of Use supersede any prior agreements between Users and DKAT.

The Conditions of Use may be amended from time to time, by DKAT in its sole discretion.

EACH USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT THE USER'S SOLE RISK. NEITHER DKAT NOR ANY OF ITS LICENSORS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES DKAT OR ANY OF ITS LICENSORS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE AND/OR THE ACCURACY OF ANY MATERIALS OR INFORMATION TO BE FOUND ON OR EXCHANGED THROUGH THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS SERVICE. NEITHER DKAT NOR ANY ONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
